This is an aspect that many don't realise exists. There are some manufacturers who won't accept a faulty product back for replcament once 14 days have elapsed from the original sale!

Or government doesn't seem to know how to look after small businesses.

 

Aren't you also protected by the sale of goods act? Ie the customer is enforcing his contract with you, but you can in turn enforce yours with the manufacturer (or distributer).

I am so glad there was a good result in the end. Whilst having sympathy with the retailer because he will be out of pocket when it is really the manufacturers fault I still feel it is a shame that the OP had to be so determined and proactive. Many a person would have not stuck to their guns in that way and would have lost out being put off and intimidated by the managers reaction. Did the manager really need educating in the matter of the Sales Of Goods Act or was his mind merely focussed by the fact that he was not going to get away with it this time and that it was going to cost a lot more if he did not give in this one time let alone any damage to the shops reputation? I am still very wary of going anywhere near the shop as I do not to want to risk the potential hassle if anything goes wrong. As for HRT....

:shame: They don't deserve your company's business, David.  But equally, you're stuck between a rock and a hard place aren't you, because if you refuse to deal with a manufacturer/distributor which is infamous in your trade for being unsupportive, then potentially someone who may have bought from you will buy from elsewhere.  What is needed is support throughout the chain.

I'm not a trader so maybe I'm talking out of my arris, but if I was starting up a small retail business selling high-value electrical items, I think I'd be having a few words with my manufacturers' distributors to see what their policies were on returns and repairs.  I don't know where the law stands for traders because I've never been one, but there must be a way for retailers to put in place a legally-binding service-level agreement with the distributors and manufacturers.

Interesting read, thanks all.

The law is quite specific in that:

1) Your contract is with the retailer.

2)The goods must be of merchantable quality.

3)Last a reasonable time( Compared to cost of product etc)

4)Perform as intended.

The guarantee is not a get out clause! In this case the OP should not have had to gone to these lengths to secure his rights under the sale of goods act!

Yes retailers are finding it hard at the present time. Business is business, they know the score!

Glad to read you got it sorted though.(But shouldnt have had to go to these lengths)

Delighted to read about sense, and the law, prevailing, albeit after an unhealthy stand off.  Compared with advertising budgets, a sensible approach like this is worth a lot, or should be.

I wonder if it is repairable?  The HRT that is, not AS's reputation.

Unlikely mate, these days it's all surface-mount technology assembled in bulk by robots. They're much more difficult to repair than 'through the hole' soldered components, and when something goes wrong the whole circuit-board often just goes in the bin. The £175 quoted by HRT would have been just a swap-out of the old circuitboard for a new one.
