46 mph in a 30 zone, consequences are........?

OH has been found wanting unfortunately.

What do you reckon

Fixed penalty and 3 points or

Court summons and something more sinister

I have to say I am quite concerned, as this could result in a hefty fine and extra points I'm thinking?

Any views at all

Do you have the speed awareness course in your area?  Having said that, at so far over the limit that may not apply.

I have to admit, 46mph in a 30mph area sounds pretty excessive.

In her defence m'lud, she did have children in the car and one had decided to vomit, just less than a mile from home etc etc.

I'd be disinclined to raise that defence (I was only speeding because I was dealing with young children in the back of the car and wasn't paying attention to my driving).

Ouch!  Not cheap.

I understand it's probably 4-6 points or disqualified for a month (uncommon) and if fined, it's based on earnings.  However, higher or lower culpability will alter the fine.  There may be useful info online if you search.  You're possibly talking a few hundred quid.  I think it depends on what is heard in court.

Because the offence is 16mph over the limit (and because it's a 30mph limit too) I'm inclined to think it may be heavier than just a standard £60+3points (depending on the driver's history re points). I too would avoid any defence including having kids in the car as it will more than likely go against you.
A speed awareness course is for those who might be 3-5mph over a 30mh limit so that won't be offered.

Think you'll find that the option of a £60 fine and doing a speed awareness course (thus avoiding the 3 points on the license) will not apply. The speed awareness course, assuming they do it in your area, only applies at speeds less than 10mph above the speed limit. Anything above that is gonna mean 3 points on the license and the fine. I speak from experience.

Being offered a speed awareness course is highly unlikely. Each local area will have its own rules, but usually (as already stated) it's max 39 or 40 in a 30.

Unless the offender is on 9 points already, I'd be surprised if the police force didn't simply offer a fixed penalty, ie £60 and 3PP. Responding promptly and politely to the NIP is more likely to make this happen.

It remains the discretion of the police whether they summons or not. I wouldn't expect them to unless disqualification is an issue, either through totting or the speed itself, which I wouldn't have thought it is.

At court, they would use the sentencing guidelines. For 41-50 in a 30 it's 4-6PP so you'd probably be looking at 5PP. And a Band B fine, ie 1 week's income, less 1/3 discount for pleading guilty.

There is no 'defence' to speeding, it's an offence of strict liability. So, if the speed is admitted, the offender is guilty. Children vomiting etc could be a 'special reason' for not imposing the points - but the offender would have to establish that they had to speed, and that they drove the minimum distance necessary etc. Not straightforward, and I suspect better to cop for the fixed penalty, if you can.

Do that in my street if I'm out the front you'll get a pickaxe or shovel in your windscreen. I once made a        in a Mercedes crash in the ditch by stepping out in front of him! I was cutting the hedge as he screetched round the corner 100m away.No excuse for driving that fast in a 30. Nick

That's not far off 50 mph in a 30; I see it all the time and it's ridiculous. No good moaning now just don't speed because one day you will hurt or kill someone at that speed. Every day I go out now I get tailgated when I'm travelling at the speed limit; I'm sick of that too. This morning on the M6 northbound I had a Jag driver come up behind me (where the road splits in two so only two lanes for a short stretch, I was doing 65-70 mph) and try to bully me out of the way by driving about six feet behind me. When I didn't speed up he undertook me and then did the same thing to the car in the inside lane. Why do these idiots get away with blatent dangerous driving every day? They're just bullies with flash cars.

 

Drivers often forget, it's a limit, not a requirement.

Oh so you were behind me? For your information I was overtaking two artics when the jag appeared from nowhere. He tried to get me to speed up and as soon as we had passed the lorries he undertook me. Don't make assumptions and don't lecture me, you weren't there and you don't know how I drive. The other thing that annoys me is all the idiots who sit in the middle lane doing 60 with a clear lane to their left. I ALWAYS go into the inside lane, even if a slower vehicle is just ahead and when most other vehicles would stay in the middle lane.

Why didn't you say that first time round? If you were attacked in the street and you decked a guy, you wouldn't miss out the crucial 'being atacked' part that proves you were justified. My comment was justified for the responce you gave. All you said is that you were undertaken inferring the left lane was clear.

My Wife's 25 y.o cousin recently got caught doing 50 in a 30 and no seatbelt.

He's been hit with 3 pts and a £120 fine.

I think your other half will most likely end up with the basic 3 pts, £60 fine.

Emotive and emetic subject this speeding malarky.

I also think you would be extremely unlucky to get any more than 3pp and a £60 fine- without condoning 46  in a 30 but having had kids,I know what that entails.Sometimes you get the feeling using a phone is safer than having 2 kids in a car(not condoning that either) (the phone not the kids)
